These are the terms and conditions by which you can purchase devices, namely mobile phones, through our website. The term \u2018device\u2019 in these terms and conditions refer to mobile phones, but may in time include other devices, such as tablet computers and smart watches.<\/p>\n<p><strong>1.2\u00a0\u00a0Why you should read them<\/strong>. Please read these terms carefully before you proceed to purchase a device through our site. These terms tell you who we are, how we facilitate the purchase of your device, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss.<\/p>\n<p><strong>1.3\u00a0\u00a0Are you a business customer or a consumer?\u00a0 <\/strong>In some areas you will have different rights under these terms depending on whether you are a business or consumer. You are a consumer if:<\/p>\n<ul>\n<li>You are an individual.<\/li>\n<li>You are buying a device through our site wholly or mainly for your personal use (not for use in connection with your trade, business, craft or profession).<\/li>\n<\/ul>\n<div id=\"2\"><\/div>\n<p><strong>1.4\u00a0\u00a0If you are a business customer this is our entire agreement with you<\/strong>. If you are a business customer these terms constitute the entire agreement between us in relation to your purchase. You acknowledge that you have not relied on any statement, promise, representation, assurance or warranty made or given by or on behalf of us which is not set out in these terms and that you shall have no claim for innocent or negligent misrepresentation or negligent misstatement based on any statement in this agreement.<\/p>\n<p><strong>2.\u00a0 Information About Us and How to Contact Us<\/strong><\/p>\n<p><strong>2.1\u00a0\u00a0Who we are<\/strong>. We are Mozillion Limited a company registered in England and Wales. Our company registration number is 11864919 and our registered office is at Mozillion, 15 West Street, Brighton, England, BN1 2RL. Our registered VAT number is 347533194<\/p>\n<p><strong>2.2\u00a0\u00a0How to contact us<\/strong>. The quickest way to contact us is by email. You can contact us by telephoning our customer service team or by emailing us at\u00a0help@mozillion.com.<\/p>\n<p><strong>2.3\u00a0\u00a0How we may contact you<\/strong>. If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us when you created your Mozillion account.<\/p>\n<div id=\"3\"><\/div>\n<p><strong>2.4\u00a0\u00a0&#8220;Writing&#8221; includes emails<\/strong>. When we use the words &#8220;writing&#8221; or &#8220;written&#8221; in these terms, this includes emails.<\/p>\n<p><strong>3. Our Contract With You<\/strong><\/p>\n<p><strong>3.1\u00a0\u00a0How we will accept your purchase<\/strong>. Our acceptance of your purchase will take place when we email you to confirm it, at which point a contract will come into existence between you and us.<\/p>\n<p><strong>3.2\u00a0\u00a0If we cannot accept your purchase<\/strong>. If we are unable to accept your purchase for any reason, we will inform you of this by email. However, where we have been unable to accept your purchase, we will either provide you with a refund or fulfil your purchase with an alternative product if you agree to this. We will always let you know if this is the case.<\/p>\n<p><strong>3.3\u00a0\u00a0Your order number<\/strong>. We will assign an order number to your purchase when your purchase is confirmed and tell you what this is once your order to purchase a device has been accepted. It will help us if you can tell us the order number whenever you contact us about your order.<\/p>\n<div id=\"4\"><\/div>\n<p><strong>3.4\u00a0\u00a0You can only use Mozillion in the UK<\/strong>. Our website platform is solely for the promotion and sale of products in the UK. Unfortunately, we do not accept orders from addresses outside the UK.<\/p>\n<p><strong>4. Accounts<\/strong><\/p>\n<p><strong>4.1\u00a0\u00a0Mozillion Accounts.\u00a0 <\/strong>In order to purchase, you must have registered and signed up for a Mozillion account. We will not accept any offers to purchase from any individual or company that does not have a Mozillion account. To register you must provide your real name, address, phone number, email address and a valid UK credit or debit card acceptable by us. You confirm that the information you provide during the registration process (and any notification of change of such information) is true and correct.<\/p>\n<p><strong>4.2\u00a0\u00a0Security<\/strong>.\u00a0You are solely responsible in all respects for all use of and for protecting the confidentiality of any email verification number and password which may be given to or selected by you for use on our website. You may not share these with or transfer them to any third parties. You must immediately notify us of any unauthorised use of them or any other breach of security regarding our Mozillion account.<\/p>\n<p><strong>4.3 <\/strong>You must be issued with a major UK credit\/debit card that is accepted on our website and you must register that card with us, and your application for registration must otherwise be acceptable to us in our absolute discretion. Payments will me made using our current payment processing partners.<\/p>\n<div id=\"5\"><\/div>\n<p><strong>4.4\u00a0\u00a0Terms of Use<\/strong>. When signing up for a Mozillion account, you agree to comply with our Terms of Use for the platform generally. We reserve the right to remove your account at any time.<\/p>\n<p><strong>5. PURCHASING FROM MOZILLION \u2013 GENERAL INFORMATION<\/strong><\/p>\n<p><strong>5.1\u00a0\u00a0Who you\u2019re purchasing from.\u00a0<\/strong>Mozillion lists devices available for purchase and you are purchasing from Mozillion Limited. You will only be able to see what device is for sale, its price, as well as the model, colour, capacity, network and condition of the device.<\/p>\n<p><strong>5.2\u00a0\u00a0Information you provide. <\/strong>You grant us a non-exclusive, UK , irrevocable, royalty-free licence to use any information you provide to us or other users of our services, for the length of the warranty period offered by Mozillion , for example during the registration or listing process.<\/p>\n<p><strong>5.3\u00a0\u00a0Device Condition<\/strong>.\u00a0 A description of the device description will be provided on each individual listing. We categorise the condition of each device based on the following categories: &#8211;<\/p>\n<ul>\n<li><strong>&#8216;Brand New\u2019: <\/strong>This is a brand new phone that has never been used and is in its original sealed box, complete with all accessories.<\/li>\n<li><strong>&#8216;Good As New\u2019:\u00a0<\/strong>Fabulous. Hard to believe it&#8217;s not brand newo No cosmetic marks, scuffs, scratches, cracks or dentso Fully functional, powers on and works as expectedo Original manufacturer parts, no third-party replacement partso Original box and accessories includedo Battery health 95% minimumo Original software that has not been modified or jail broken<\/li>\n<li><strong>&#8216;Excellent\u2019:\u00a0<\/strong>Minimal cosmetic marks, but definitely no cracks or dentso Any light scratches\/marks on the screen are not visible at arm\u2019s lengtho Any light scratches\/marks on the phone housing are barely visible at arm\u2019s lengtho No marks or scratches on the camera bezel \/ lenso Fully functional, powers on and works as expectedo Original manufacturer parts, no third-party replacement partso Minimum 85% battery healtho Original software that has not been modified or jail broken<\/li>\n<li><strong>&#8216;Good\u2019:\u00a0<\/strong>A phone that has lived a little with moderate signs of useo Some cosmetic marks, but definitely no cracks or dentso Up to 7 light scratches\/marks on the screen, which are hardly visible when the screen is turned on.o Up to 5 light scratches\/marks on the phone housing\/camera bezelo Up to 3 light chips\/scuffs on the phone housing\/camera bezelo No scratches on the camera lenso Fully functional, it powers on and works as expectedo Original manufacturer parts, no third-party replacement partso Minimum 85% battery healtho Original software that has not been modified or jail broken<\/li>\n<\/ul>\n<p>Although we administer a number of checks on each pre-owned and refurbished device to ensure each listing is accurate, if the device condition listed on our website does not match the device you receive, you may be entitled to a refund or replacement.<\/p>\n<p><strong>5.4\u00a0\u00a0Warranties. <\/strong>When you purchase a phone from through our site, you will be provided with a 12 month warranty directly by us. Tablets will be provided with a 12 month warranty. We will be responsible for ensuring we deal with any issues you may have and solving these for you, we will either repair, replace or refund depending on what is more cost effective for us at the time of the warranty claim.<\/p>\n<p><strong>5.5\u00a0\u00a0Buying Options.<\/strong>\u00a0Listings will either include a \u201cbuy it now\u201d price \u2013 enabling you to buy a device at a set price, or you can list an offer below the \u201cbuy it now\u201d price and see if the price for the device moves \u2013 this is where an asking price and an offer you\u2019ve made, match. When this happens, a transaction occurs and a trade confirmation will take place.<\/p>\n<div id=\"6\"><\/div>\n<p><strong>5.6\u00a0\u00a0Product packaging.<\/strong>\u00a0All devices, will be sent in a \u2018Mozillion\u2019 box and contain the device you\u2019ve purchased. Packaging of the device may vary from that shown in images on our website, as website images are stock images and for illustration purposes only.<\/p>\n<p><strong>6. GENERAL RULES governing BUYING<\/strong><\/p>\n<p><strong>6.1\u00a0\u00a0To use and rely on our Mozillion services we provide,<\/strong>\u00a0all participants, must understand their obligations to other users of Mozillion services. If you make an order to buy goods and we accept your order, you must complete the transaction.<\/p>\n<p><strong>6.2\u00a0\u00a0Your making of an order entitles us <\/strong>to rely on your order and as a result you confirm and undertake that you have the legal right to make such an order and to enter into any such transaction.<\/p>\n<p><strong>6.3\u00a0\u00a0If your order is accepted, <\/strong>you have entered into a contract to buy the item. You can only terminate that contract in limited circumstances set out in law, for example where the item does not materially comply with the information provided in relation to it. We may refuse to accept your order for whatever reason.<\/p>\n<p><strong>6.4\u00a0\u00a0With regard to returns and refunds, <\/strong>please read paragraph 10. Your acceptance of these terms and conditions entitles us to assume you have read this paragraph.<\/p>\n<div id=\"7\"><\/div>\n<p><strong>6.5\u00a0\u00a0Mozillion reserves the right to remove any account <\/strong>or prevent a trade from taking place in the event that we believe a buyer is found to be manipulating prices or markets.<\/p>\n<p><strong>7. Your Rights to Make Changes<\/strong><\/p>\n<div id=\"8\"><\/div>\n<p>If you wish to make a change to the device you have ordered please contact us, for example, if you wanted to change the quantity. We will let you know if the change is possible. If it is possible we will let you know about any changes to the price, the timing of supply or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change.<\/p>\n<p><strong>8. PRE-OWNED DEVICE CHECKS AND Changes<\/strong><\/p>\n<p><strong>8.1\u00a0\u00a0Our checks<\/strong>. We run a series of diagnostic checks on all pre-owned devices, to ensure the device works as it should and to ensure the device is not blacklisted or stolen.<\/p>\n<p><strong>8.2\u00a0\u00a0Data. <\/strong>We ensure that any device you buy from us is wiped of all data contained on it. It will be supplied to you with factory settings enabled and no trace of any previous use. We wipe data in accordance with CESG standards, using a specialist third party.<\/p>\n<div id=\"9\"><\/div>\n<p><strong>8.3\u00a0\u00a0More significant changes to devices and these terms<\/strong>. In addition, as we informed you in the description of the device on our website, we may make some changes to these terms, but if we do so we will notify you and you may then contact us to end the contract before the changes take effect and receive a refund for any products paid for but not received.<\/p>\n<p><strong>9. Providing the Products<\/strong><\/p>\n<p><strong>9.1\u00a0\u00a0Delivery costs<\/strong>. The costs of delivery will be as displayed to you prior to you making an offer to purchase a device. We use a number of different couriers depending on the nature of the delivery and the service you have chosen.<\/p>\n<p><strong>9.2\u00a0\u00a0Delivery<\/strong>. We will deliver devices to you as soon as reasonably possible and in any event within 1-4 days after the day on which you have completed a transaction on our site. If you have chosen our premium service and have completed the transaction before our displayed cut off times, this could be next day delivery.<\/p>\n<p><strong>9.3\u00a0\u00a0We are not responsible for delays outside our control<\/strong>. If our supply of the devices are delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any products you have paid for but not received.<\/p>\n<p><strong>9.4\u00a0 If you are not at home when the device is delivered<\/strong>. If no one is available at your address to take delivery and the products cannot be posted through your letterbox, you will need to rearrange delivery or collect the device from a local depot. Deliveries are made different couriers who will provide further information on how to facilitate the re-delivery or collection, as it may be.<\/p>\n<p><strong>9.5\u00a0\u00a0When you become responsible for the device<\/strong>. The device will be your responsibility from the time the device is delivered to the address you gave us.<\/p>\n<p><strong>9.6\u00a0\u00a0When you own a device<\/strong>. You own the device only once we have received payment in full.<\/p>\n<p><strong>9.7\u00a0\u00a0What will happen if you do not give required information to us<\/strong>. We may need certain information from you so that we can supply a device to you, for example, up to date information on your Mozillion account. If we need further information, we will contact you to ask for this information. If you do not give us this information within a reasonable time of us asking for it, or if you give us incomplete or incorrect information, we may end the contract to supply you with a device. We will not be responsible for supplying any device late or not supplying any part of them if this is caused by you not giving us the information we need within a reasonable time of us asking for it.<\/p>\n<p><strong>9.8\u00a0\u00a0Reasons we may suspend the supply of products to you<\/strong>. We may have to suspend supplying a device to you to:<\/p>\n<p><strong>9.8.1 \u00a0deal with technical problems or make minor technical changes;<\/strong><\/p>\n<p><strong>9.8.2\u00a0\u00a0update the device to reflect changes in relevant laws and regulatory requirements;<\/strong><\/p>\n<p><strong>9.8.3\u00a0\u00a0make changes to the product as requested by you or notified by us to you (see paragraph 8).<\/strong><\/p>\n<div id=\"10\"><\/div>\n<p><strong>9.9\u00a0\u00a0Your rights if we suspend the supply of a device<\/strong>. We will contact you in advance to tell you we will be suspending supply of a device, unless the problem is urgent or an emergency. If we have to suspend the device, you may contact us to end the contract if we suspend it, or tell you we are going to suspend it.<\/p>\n<p><strong>10.\u00a0\u00a0RETURNS, REFUNDS and defective devices<\/strong><\/p>\n<p><strong>10.1 Refunds and returns: <\/strong>You have the statutory right to cancel your order for any reason within 14 days beginning with the day you receive the item. Mozillion will provide you with up to a 12 month warranty directly from us for mobile phones and 12 months for tablets, details of which will be provided to you when you complete a transaction. The details we will provide you with will also confirm the length of the warranty we will offer, if this is different to the standard warranty provided under this clause 10.1. This will cover scenarios such as the device being not fit for purpose, is not as it is described or is faulty. See paragraph 11 for further details.<\/p>\n<p><strong>10.3 We will make any refunds due to you as soon as possible once approved<\/strong>\u00a0and in any event within 14 days after the day on which we receive the device back from you and the return is approved.<\/p>\n<p><strong>10.3.1 Return cost and method, <\/strong>within the 14-day statutory period the cost is paid for by the buyer, a suitable tracked and insured method of return should be used, Mozillion will not accept any responsibility or financial liability for a non-delivered item. For a return outside of the 14-day period, the cost is paid for by the buyer. Mozillion will not be liable for any financial loss for a non-delivered item. If the device is found to be faulty, Mozillion shall reimburse the buyer for the postage cost of returning the device to Mozillion, up to maximum of \u00a38.75 unless otherwise agreed (proof of postage cost paid may be required). If no fault is found, the cost of return and re-delivery will be paid for by the buyer on despatch. Mozillion will not be liable for any financial loss for a non-delivered item. It is recommended that any item being returned to Mozillion, that a fully insured tracked service, such as Royal Mail Special Delivery, is used along with the correct insurance as to financial value.<\/p>\n<p><strong>10.4 Exclusions,<\/strong>\u00a0new devices must be returned, unopened, unused, in the original manufacturer packaging, correlating IMEI and serial number, undamaged. If a brand new device has been opened and the security seals broken and\/or the device or manufacturer packaging is damaged in any way, we may offset any refund by the diminished amount of the product. Refurbished devices must be returned complete with the accessories supplied, identical IMEI, undamaged, in the original grade of condition as supplied, any damage or degradation of grade due to use may result in an offset in any refund due to the diminished grade, relating to Good As New, Excellent and Good. If a device does not meet the lowest criteria described as Good for resale due to damage no refund will be issued and the cost of return to be paid for by the buyer.<\/p>\n<div id=\"11\"><\/div>\n<p><strong>10.5 Refunds &amp; Blacklisting, i<\/strong>f in the event that any device is refunded, the ownership and title reverts to Mozillion. If any device is blacklisted the title reverts to the seller, whereby Mozillion will be reimbursed by the seller.<\/p>\n<p><strong>11.\u00a0 MOZILLION WARRANTY<\/strong><\/p>\n<p><strong>11.1 Whenever you purchase a device <\/strong>on our website, we warrant that on delivery, and for a period of up to 12 months for phones and 12 months for tablets, from the date of delivery (warranty period), all devices shall:<\/p>\n<p><strong>11.1.1\u00a0\u00a0conform with their description;<\/strong><\/p>\n<p><strong>11.1.2\u00a0\u00a0be free from material defects in design, material and workmanship;<\/strong><\/p>\n<p><strong>11.1.3\u00a0\u00a0be of satisfactory quality (within the meaning of the Sale of Goods Act 1979).<\/strong><\/p>\n<p><strong>11.2 Subject to paragraph 11.3, if:<\/strong><\/p>\n<p><strong>11.2.1\u00a0\u00a0you give us notice in writing during the warranty period within a reasonable time of discovery that a device does not comply with the warranty<\/strong><\/p>\n<p><strong>11.2.2\u00a0\u00a0we are given a reasonable opportunity of examining such device; and<\/strong><\/p>\n<p><strong>11.2.3\u00a0\u00a0you return such device to us using the delivery method that we will send you, we shall, at our option, repair or replace the defective device, or refund the price of the defective device in full.<\/strong><\/p>\n<p><strong>11.3 We will not be liable for a device&#8217;s failure to comply with the warranty in paragraph 11.1 if:<\/strong><\/p>\n<p><strong>11.3.1\u00a0\u00a0you make any further use of such device after giving a notice in accordance with paragraph 11.2.1;<\/strong><\/p>\n<p><strong>11.3.2 the defect arises because you failed to follow our oral or written instructions as to the storage, installation, commissioning, use or maintenance of the device or (if there are none) good trade practice;<\/strong><\/p>\n<p><strong>11.3.3 you alter or repair the device without telling us;<\/strong><\/p>\n<p><strong>11.3.4\u00a0\u00a0water or liquid damage;<\/strong><\/p>\n<p><strong>11.3.5\u00a0\u00a0damage caused to removable covers such as battery covers, port\/interface covers and lens caps;<\/strong><\/p>\n<p><strong>11.3.6\u00a0\u00a0you attempt or have attempted to root or jailbreak the device; or<\/strong><\/p>\n<p><strong>11.3.7 the defect arises as a result of fair wear and tear, wilful damage, negligence, or abnormal working conditions.<\/strong><\/p>\n<p><strong>11.4 These terms shall apply to any repaired or replacement devices supplied by us under paragraph 11.2.<\/strong><\/p>\n<div id=\"12\"><\/div>\n<p><strong>11.5 Once we have dealt with a warranty issue, we will return your device to you free of charge one of our courier partners. If your device fails to comply with the warranty, due to one of the reasons listed above, you will be liable for the cost of return of the device.<\/strong><\/p>\n<p><strong>12.\u00a0\u00a0Our Rights to End the Contract<\/strong><\/p>\n<p><strong>12.1 We have in our sole discretion the right to issue a warning, temporary suspension, or an indefinite suspension and termination of your rights to use our platform if you:<\/strong><\/p>\n<p><strong>12.1.1 act inconsistently and in breach of these terms;<\/strong><\/p>\n<p><strong>12.1.2 at any time violate or attempt to violate any rights of any other platform user or third party;<\/strong><\/p>\n<p><strong>12.1.3\u00a0\u00a0are engaged in any fraudulent activity (including any market manipulation); or<\/strong><\/p>\n<p><strong>12.1.4 fail to make any payments due to us in accordance with these terms.<\/strong><\/p>\n<div id=\"13\"><\/div>\n<p><strong>12.2 On termination, <\/strong>all rights and obligations of the parties under these terms will, except that such rights and obligations will remain in effect after such termination to the extent necessary to process any orders placed prior to such termination for devices listed by a seller using the platform.<\/p>\n<p><strong>13.\u00a0\u00a0If There Is a Problem With a device<\/strong><\/p>\n<p><strong>13.1 How to tell us about problems. <\/strong>If you have any questions or complaints about a device, please contact us. You can telephone our customer service team or email us at\u00a0help@mozillion.com.<\/p>\n<p><strong>13.2 If your device is faulty<\/strong>. If your device is found to be faulty or develops a fault within the first 12 months of of purchase, Mozillion will offer you the choice to have the device repaired or replaced, subject to our warranty and return terms and conditions.<\/p>\n<p><strong>13.3 If your device is not as described. <\/strong>If upon receiving the device you find it is damaged or not in the condition expected then you need to report this to us using one of the methods stated in 13.1 within 24 hours of the phone being delivered to you.<\/p>\n<p><strong>13.4 Summary of your legal rights.<\/strong>See the box below for a summary of your key legal rights in relation to your device. For detailed information please visit the Citizens Advice website www.adviceguide.org.uk or call\u00a0<a href=\"tel:03454 04 05 06\">03454 04 05 06<\/a>.<\/p>\n<p>The Consumer Rights Act 2015 says goods must be as described, fit for purpose and of satisfactory quality. During the expected lifespan of your product your legal rights entitle you to the following:<\/p>\n<p>&#8211; Up to thirty days: if your goods are faulty, then you can get an immediate refund.<\/p>\n<p>&#8211; Up to six months: if your goods can&#8217;t be repaired or replaced, then you&#8217;re entitled to a full refund, in most cases.<\/p>\n<p>&#8211; Up to six years (five years in Scotland): if your goods do not last a reasonable length of time you may be entitled to some money back.<\/p>\n<\/td>\n<\/tr>\n<tr>\n<td><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><strong>14.\u00a0\u00a0Price and Payment<\/strong><\/p>\n<p><strong>14.1 Where to find the price for the device.<\/strong>\u00a0The requested price of the device will be the price indicated on the listing pages as a \u2018buy it now\u2019 price. Alternatively, you can make an offer to purchase the device at a lower price. If the device does not have a \u2018buy it now\u2019 price, you will need to make an offer which may be accepted or declined.<\/p>\n<p><strong>14.2 When you must pay and how you must pay<\/strong>. We only accept payment by UK credit or debit card\/Paypal and you must pay for devices before they are dispatched. Mozillion reserves the right to request proof of payment method, proof of address and proof of identity to validate a transaction as deemed necessary, to prevent fraudulent transactions.<\/p>\n<p><strong>14.3 Our right of set-off if you are a business customer<\/strong>. If you are a business customer you must pay all amounts due to us under these terms in full without any set-off, counterclaim, deduction or withholding (other than any deduction or withholding of tax as required by law).<\/p>\n<div id=\"15\"><\/div>\n<p><strong>14.4 We can charge interest if you pay late<\/strong>. If you do not make any payment to us by the due date we may charge interest to you on the overdue amount at the rate of 4% a year above the base lending rate of Barclay\u2019s Bank from time to time. This interest shall accrue on a daily basis from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You must pay us interest together with any overdue amount.<\/p>\n<p><strong>15.\u00a0\u00a0INSURANCE<\/strong><\/p>\n<div id=\"16\"><\/div>\n<p><strong>15.1 When you purchase a device,<\/strong>\u00a0you have the option of purchasing additional insurance for an extended warranty, through Warranty and Creditor Services, who are a third party and who we are not affiliated with. It is entirely at your discretion as to whether you want to purchase additional insurance. Details are available on our website.<\/p>\n<p><strong>16.\u00a0\u00a0Our Responsibility for Loss or Damage Suffered By You If You Are a Consumer<\/strong><\/p>\n<p><strong>16.1 We are responsible to you for foreseeable loss and damage caused by us<\/strong>. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process.<\/p>\n<p><strong>16.2\u00a0\u00a0We do not exclude or limit in any way our liability to you where it would be unlawful to do so<\/strong>. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the devices.<\/p>\n<div id=\"17\"><\/div>\n<p><strong>16.3\u00a0\u00a0We are not liable for business losses<\/strong>. If you are a consumer we only supply the devices for to you for domestic and private use. We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.<\/p>\n<p><strong>19.2 You need our consent to transfer your rights to someone else. <\/strong>You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing. For the avoidance of doubt the warranty supplied with the handset is not transferrable<\/p>\n<p><strong>19.3\u00a0\u00a0Nobody else has any rights under this contract<\/strong>. This contract is between you and us. No other person shall have any rights to enforce any of its terms.<\/p>\n<p><strong>19.4\u00a0\u00a0If a court finds part of this contract illegal, the rest will continue in force. <\/strong>Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.<\/p>\n<p><strong>19.5\u00a0\u00a0Even if we delay in enforcing this contract, we can still enforce it later<\/strong>. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide the devices, we can still require you to make the payment at a later date.<\/p>\n<p><strong>19.6\u00a0\u00a0Which laws apply to this contract and where you may bring legal proceedings if you are a consumer<\/strong>. These terms are governed by English law and you can bring legal proceedings in respect of the devices in the English and Welsh courts. If you live in Scotland you can bring legal proceedings in respect of the devices in either the Scottish or the English and Welsh courts. If you live in Northern Ireland you can bring legal proceedings in respect of the devices in either the Northern Irish or the English courts.<\/p>\n<div id=\"20\"><\/div>\n<p><strong>19.7\u00a0\u00a0Which laws apply to this contract and where you may bring legal proceedings if you are a business<\/strong>. If you are a business, any dispute or claim arising out of or in connection with a contract between us or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales and the courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or\u00a0<a id=\"selling_terms\"><\/a>claim.<\/p>\n<p>&nbsp;<\/p>\n<h4><strong>Selling Terms and Conditions<\/strong><\/h4>\n<p><strong>20.\u00a0\u00a0These Terms<\/strong><\/p>\n<p><strong>20.1 What these terms cover. <\/strong>These are the terms and conditions by which you can sell devices, namely mobile phones, on our website. The term \u2018device\u2019 in these terms and conditions refer to mobile phones, but may in time include other devices, such as tablet computers and smart watches.<\/p>\n<p><strong>\u00a020.2 Why you should read them. <\/strong>Please read these terms carefully before you proceed to sell on our site. These terms tell you who we are, how we facilitate the sale of your device, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss.<\/p>\n<p><strong>20.3 Are you a business customer or an individual\/consumer? <\/strong>In some areas you will have different rights under these terms depending on whether you are a business or an individual\/consumer. You are a consumer if:<\/p>\n<ul>\n<li><strong>You are an individual.<\/strong><\/li>\n<li><strong>You are selling devices on our website wholly or mainly for your personal use (not for use in connection with your trade, business, craft or profession).<\/strong><\/li>\n<\/ul>\n<p>Provisions specific to consumers only are set out and clearly stated within these terms and those specific to businesses only are also clearly set out.<\/p>\n<div id=\"21\"><\/div>\n<p><strong>20.4 If you are a business customer this is our entire agreement with you.<\/strong>f you are a business customer these terms constitute the entire agreement between us in relation to your sale of devices. You acknowledge that you have not relied on any statement, promise, representation, assurance or warranty made or given by or on behalf of us which is not set out in these terms and that you shall have no claim for innocent or negligent misrepresentation or negligent misstatement based on any statement in this Agreement.<\/p>\n<p><strong>21.\u00a0\u00a0Information About Us and How to Contact Us<\/strong><\/p>\n<p><strong>21.1 Who we are. <\/strong>We are Mozillion Limited a company registered in England and Wales. Our registered VAT number is 347533194.<\/p>\n<p><strong>21.2 How to contact us. <\/strong>You can contact us by emailing us at\u00a0help@mozillion.com.<\/p>\n<p><strong>21.3 How we may contact you. <\/strong>If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us when you created your Mozillion account.<\/p>\n<div id=\"22\"><\/div>\n<p><strong>21.4 &#8220;Writing&#8221; includes emails. <\/strong>When we use the words &#8220;writing&#8221; or &#8220;written&#8221; in these terms, this includes emails.<\/p>\n<p><strong>22.\u00a0\u00a0Our Contract With You<\/strong><\/p>\n<p><strong>22.1 How we will accept your listing. <\/strong>Our acceptance of your listing will take place when we confirm we have received and accepted your listing, at which point a contract will come into existence between you and us for the selling of your device to Mozillion.<\/p>\n<p><strong>22.2 If we cannot accept your listing. <\/strong>If we are unable to accept your listing, we will inform you of this and, subsequently, your device will not be listed on our site. This might be because, for example, the phone you are trying to sell is described incorrectly, because of any issues regarding title and ownership of the phone or because we have identified an error or problem with your account as to previous sales.<\/p>\n<p><strong>22.3 Your listing number. <\/strong>For each listing we accept, we will assign you a unique number to your listing and tell you what it is when we accept that listing. If you need to discuss a listing with us, it will help us if you can tell us the listing number whenever you contact us.<\/p>\n<div id=\"23\"><\/div>\n<p><strong>22.4 We mainly list and sell UK devices.<\/strong>\u00a0Our website is largely for the purchase and sale of our devices in the UK. Although in some cases we can list non-UK mobile devices, we reserve the right not to do so and may prohibit non-UK sales at our sole discretion.<\/p>\n<p><strong>23.\u00a0\u00a0Accounts<\/strong><\/p>\n<p><strong>23.1 Mozillion Accounts. <\/strong>In order to sell to Mozillion, you must have registered and signed up for a Mozillion account. We will not accept any listings from any individual or company that does not have a Mozillion account.<\/p>\n<p><strong>23.2 Security. <\/strong>You are solely responsible in all respects for all use of and for protecting the confidentiality of any email verification number and password which may be given to or selected by you for use on our website. You may not share these with or transfer them to any third parties. You must immediately notify us of any unauthorised use of them or any other breach of security regarding our Mozillion account.<\/p>\n<div id=\"24\"><\/div>\n<p><strong>23.3 Terms of Use. <\/strong>When signing up for a Mozillion account, you agree to comply with our Terms of Use. We reserve the right to remove your account at any time.<\/p>\n<p><strong>24.\u00a0\u00a0LISTING PROCESS<\/strong><\/p>\n<p><strong>24.1 Device Description. <\/strong>When you list a device, whether as a consumer or a business customer, you will be required to list it under one of the following categories, that correspond with the condition of the device you want to sell. These categories are as follows:<\/p>\n<ul>\n<li><strong>&#8216;New\u2019:\u00a0<\/strong>This is a brand new phone that has never been used and is in its original sealed box, complete with all accessories.<\/li>\n<li><strong>&#8216;Good As New\u2019:\u00a0<\/strong>Fabulous. Devices being sold via third-parties such as but not limited to recycling comparison sites, have their own applicable condition descriptions and grading requirements.<\/p>\n<p><strong>24.2 Information you provide. <\/strong>You grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free licence to use any information you provide to us or other users of our services, for example during the registration or listing process.<\/p>\n<p><strong>24.3 Device Models.<\/strong>\u00a0You will only be able to sell the models of phone listed on our site. If you wish to sell a model that does not appear on our site, you will need to contact us to make a sell request. We will then confirm whether you are able to list and sell your device.<\/p>\n<p><strong>24.4 Device Condition <\/strong>You will need to describe the condition of each device before it is listed using the categories in paragraph 24.1. Any device sent to us that does not accurately reflect the description provided, that is faulty, blacklisted, or the sale cancelled due to late shipping, if received, subsequently will be subject to a return fee of \u00a315.<\/p>\n<p><strong>24.4.1 Seller\u2019s Conditions <\/strong>In the event that a phone becomes blocked, all sellers will be liable to reimburse Mozillion for the full refund issued to the buyer, along with any delivery and administration costs incurred.<\/p>\n<p><strong>24.5 Device Images. <\/strong>The images of the devices on our website are stock images, for illustrative purposes only. You will be unable to upload your own device images. Although we have made every effort to display the colours accurately on our site, we cannot guarantee that a device&#8217;s display of the colours accurately reflects the colour of the devices. Your device may vary slightly from those images.<\/p>\n<div id=\"25\"><\/div>\n<p><strong>24.6 Selling Options. <\/strong>Once we have accepted a listing, your device will be listed on our site. When listing your device, you can either include a \u201cbuy it now\u201d price \u2013 enabling Mozillion to buy your device at a set price, or you can list at your own price and see if an offer is made for your device. You can then choose whether to accept one of these offers, at which point a \u2018trade\u2019 is made and Mozillion will purchase your device.<\/p>\n<p><strong>25.\u00a0\u00a0GENERAL RULES when selling<\/strong><\/p>\n<p><strong>25.1 In relation to any device you list for sale:<\/strong><\/p>\n<p><strong>25.1.1 you must be the absolute unencumbered legal owner with the right to sell that device, Mozillion reserves the right to request the original proof of purchase as deemed necessary<\/strong><\/p>\n<p><strong>25.1.2 your sale of the device must not infringe any third party rights or be unlawful in any way;<\/strong><\/p>\n<p><strong>25.1.3 you must list your device in the correct category with accurate and appropriate descriptions and provide such information as we may request (see paragraph 24); and<\/strong><\/p>\n<div id=\"26\"><\/div>\n<p><strong>25.1.4 although we will wipe all devices of any data contained on it, it still must not contain any offensive material, including material that incites racial hatred or promotes discrimination based on race, sex, religion, national origin, physical ability, sexual orientation or age.<\/strong><\/p>\n<p><strong>26.\u00a0\u00a0Your Rights to Make Changes<\/strong><\/p>\n<div id=\"27\"><\/div>\n<p>If you wish to make a change to a listing you have requested please contact us. We will let you know if the change is possible. If it is possible we will let you know about any specific changes to the device you have requested to sell, or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change.<\/p>\n<p><strong>27.\u00a0\u00a0Selling Process<\/strong><\/p>\n<p><strong>27.1 Once you have a confirmed sale, <\/strong>we will ask you to send your device directly to us within two business days or if you have used our premium service give directly to the courier after validating the authority of the pick up by a pin authorisation or any other means we choose to use.. We will email you instructions on how to send your device back, we highly recommend that you only send one device per package to ensure any insurance that may be included covers the value of the package. Once we have received your device, we will ensure it matches the device condition contained within your sell order (see paragraph 24.4).<\/p>\n<p><strong>27.2 Any device sent to us must: &#8211;<\/strong><\/p>\n<p><strong>27.2.1 not be activation locked;<\/strong><\/p>\n<p><strong>27.2.2 be deregistered from any associated account;<\/strong><\/p>\n<p><strong>27.2.3 have its sim card removed; and<\/strong><\/p>\n<p><strong>27.2.4 match the device description and condition you provided in your sell order.<\/strong><\/p>\n<p><strong>27.2.5 \u00a0The battery health must be 85% or above for Apple iPhones in \u2018Good\u2019 or \u2018Excellent\u2019 condition and 95% or above for Apple iPhones in \u2018Good As New\u2019 condition. The battery health for all other devices must be &#8216;healthy&#8217;.<\/strong><\/p>\n<p><strong>27.2.6 The device must contain only original manufacturer parts and components, including, but not limited to the display, screen, camera, battery and casing.<\/strong><\/p>\n<p><strong>27.2.7 The device must not have been modified in any way.<\/strong><\/p>\n<p><strong>27.3 Our checks.<\/strong>\u00a0We will run a series of diagnostic checks on your device, to ensure the device works as it should, contains and uses only original manufacturer parts and components and to ensure the device is not blacklisted or stolen. Any device that does not pass these checks will be returned to you and a transaction fee imposed at our sole discretion \u2013 see paragraph 24.4. We will certify all devices that pass our checks and ensure this is listed next to your device listing.<\/p>\n<p><strong>27.4 Data. <\/strong>As part of our checks, we will complete a data wipe of your device in accordance with CESG standards, via a third party that we work with.<\/p>\n<p><strong>27.5 Age Restrictions. <\/strong>You must be 16 years of age or older to sell any device on Mozillion&#8217;s website.<\/p>\n<div id=\"28\"><\/div>\n<p><strong>27.6 Unsuccessful deliveries. <\/strong>If we return your device and the carrier returns it to us because delivery was unsuccessful, we will contact you to arrange redelivery. If you do not reply within 180 days, we will dispose of the device with no further payments due from or to anybody<\/p>\n<p><strong>28.\u00a0\u00a0PAYMENTS AND COMMISSION<\/strong><\/p>\n<p><strong>28.1\u00a0\u00a0Payments<\/strong>. All payments will be held by our payment partners and transferred by them when the transaction has been approved, on occasion we may make payments directly to sellers using bank transfers or other means. This will be the case regardless of whether you are selling a new or pre-owned phone. Following completion of a transaction, we will send this to you within 14 days of us receiving payment from the buyer, less any fees. If you are using our premium service we may at our discretion only make payment if we have been able to verify you and your identity by using third party application and platforms.<\/p>\n<p><strong>28.2\u00a0\u00a0Commission Rates. <\/strong>We charge a seller fee of 14.9% for each device sold to Mozillion, which we will deduct from the payment, before sending the remaining amount to you.<\/p>\n<p><strong>28.3\u00a0\u00a0Commission Cap. <\/strong>In the case of individual device sales over \u00a31500, the fee will be capped at \u00a3150.<\/p>\n<p><strong>28.4\u00a0\u00a0Taxes<\/strong>.\u00a0All payments and commission rates charged by us include value added tax.<\/p>\n<p><strong>28.5 Return costs<\/strong>\u00a0If a phone does not meet the criteria as described within these terms and conditions and the transaction is cancelled and the seller will be required to pay the administration charge to cover the cost of delivery to and from Mozillion. This fee must be paid prior to despatch, and Mozillion\u2019s decision as to condition, grade, fault, battery condition, not fit for purpose is final.<\/p>\n<div id=\"29\"><\/div>\n<p><strong>28.6 The seller is bound<\/strong>\u00a0to provide the correct IMEI of the phone sold once the sale is confirmed, if the IMEI is not confirmed post sale, Mozillion reserves the right to cancel the order and condition 28.5 applies<\/p>\n<p><strong>29.\u00a0\u00a0Delivery<\/strong><\/p>\n<p><strong>29.1\u00a0\u00a0Delivery Process<\/strong>. Once a transaction has been concluded and payment received by us from a buyer, we will send the device to them by courier to the address provided by the buyer.<\/p>\n<div id=\"30\"><\/div>\n<p><strong>29.2\u00a0\u00a0Notification<\/strong>. We will let you know when we have sent your device to the buyer, either by email or through your Mozillion account<\/p>\n<p><strong>30.\u00a0\u00a0WARRANTY and refunds<\/strong><\/p>\n<p><strong>30.1\u00a0\u00a0Warranty on devices.<\/strong>\u00a0As we check all consumer devices (see paragraph 27.3), we offer the buyer of your device up to a 12 month warranty on each device (12 months on tablets).<\/p>\n<p><strong>30.2\u00a0\u00a0Refunds<\/strong>. If a buyer returns the device to us, we will take ownership of any returned device before deciding what to do next, whether this be repairing the device or relisting it. This will not affect you in any way and we will not ask you to return any money to us unless clause 25.1.1 applies.<\/p>\n<div id=\"31\"><\/div>\n<p><strong>30.3 Business sellers are fully liable<\/strong>for all refunded devices, and not withstanding a 12-month warranty.<\/p>\n<p><strong>31.\u00a0\u00a0How to End the Contract With Us<\/strong><\/p>\n<p><strong>31.1 Tell us you want to end the contract<\/strong>. To end a listing, please let us know by doing one of the following:<\/p>\n<p><strong>31.1.1\u00a0\u00a0Phone or email<\/strong>. Email us at\u00a0help@mozillion.com. Please provide your name, Mozillion account details and details of the request and, where available, your phone number and email address.<\/p>\n<p><strong>31.1.2\u00a0\u00a0Online<\/strong>. Delete any listing on our site following the links from your account (so long as a transaction has not taken place)<\/p>\n<div id=\"32\"><\/div>\n<p><strong>31.2\u00a0\u00a0When you can end the contract<\/strong>. You can end the contract with us at any point prior to a trade being confirmed, (whether either a by providing us with the information required in this paragraph 31. If you have sent us your device and, subsequently, end the contract, we may charge you postage fees to return your device to you. Please note, that if you are a business customer, ending the contract with us does not end your contract with each buyer of your device, created when you accept an offer from a buyer or accepting a \u201cbuy it now\u201d offer.<\/p>\n<p><strong>32.\u00a0\u00a0Our Rights to End the Contract<\/strong><\/p>\n<p><strong>32.1\u00a0\u00a0We may end the contract if you break it<\/strong>. We have in our sole discretion the right to issue a warning, temporary suspension, or an indefinite suspension and termination of your rights to use and sell on the platform if:<\/p>\n<p><strong>32.1.1\u00a0\u00a0you do not, within a reasonable time of us asking for it, provide us with information that is necessary for us to list your device;<\/strong><\/p>\n<p><strong>32.1.2\u00a0\u00a0you act inconsistently and in breach of these terms;\u00a0 \u00a0\u00a0<\/strong><\/p>\n<p><strong>32.1.3 you at any time violate or attempt to violate any rights of any other user of the platform or third party;<\/strong><\/p>\n<p><strong>32.1.4\u00a0\u00a0we become aware of you not complying with the obligations owed to a buyer, such as providing a warranty and administering refunds; or<\/strong><\/p>\n<div id=\"33\"><\/div>\n<p><strong>32.1.5\u00a0\u00a0you are engaged in any fraudulent activity.<\/strong><\/p>\n<p><strong>33.\u00a0\u00a0If There are any Problems<\/strong><\/p>\n<div id=\"34\"><\/div>\n<p><strong>33.1 How to tell us about problems. <\/strong>If you have any questions or complaints about Mozillion or the services we provide, please contact us. You can email us at\u00a0<a href=\"mailto:help@mozillion.com\">help@mozillion.com<\/a>\u00a0or write to us at Mozillion, Cube House, Bell Lane, Uckfield, East Sussex, TN22 1QL.<\/p>\n<p><strong>34.\u00a0\u00a0Our Responsibility for Loss or Damage Suffered By You If You Are a Consumer<\/strong><\/p>\n<p><strong>34.1\u00a0\u00a0We are responsible to you for foreseeable loss and damage caused by us<\/strong>. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process.<\/p>\n<p><strong>34.2\u00a0\u00a0We do not exclude or limit in any way our liability to you where it would be unlawful to do so<\/strong>. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; and for defective devices returned to you under the Consumer Protection Act 1987.<\/p>\n<div id=\"35\"><\/div>\n<p><strong>34.3\u00a0\u00a0We are not liable for business losses<\/strong>. If you are a consumer we only list devices for you for domestic and private use. If you use the device for any commercial, business or re-sale purpose our liability to you will be limited as set out in paragraph 35.<\/p>\n<p><strong>35.\u00a0\u00a0Our Responsibility for Loss or Damage Suffered By You If You Are a Business CUSTOMER<\/strong><\/p>\n<p><strong>35.1\u00a0\u00a0Nothing in these terms shall limit or exclude our liability for:<\/strong><\/p>\n<p><strong>35.1.1\u00a0\u00a0death or personal injury caused by our negligence, or the negligence of our employees, agents or subcontractors (as applicable);<\/strong><\/p>\n<p><strong>35.1.2\u00a0\u00a0fraud or fraudulent misrepresentation;<\/strong><\/p>\n<p><strong>35.1.3\u00a0\u00a0breach of the terms implied by section 12 of the Sale of Goods Act 1979 or section 2 of the Supply of Goods and Services Act 1982; or<\/strong><\/p>\n<p><strong>35.1.4 defective devices returned to you under the Consumer Protection Act 1987; or<\/strong><\/p>\n<p><strong>35.1.5\u00a0\u00a0any matter in respect of which it would be unlawful for us to exclude or restrict liability.<\/strong><\/p>\n<p><strong>35.2\u00a0\u00a0Except to the extent expressly stated in these terms, all terms implied by sections 13 to 15 of the Sale of Goods Act 1979 and sections 3 to 5 of the Supply of Goods and Services Act 1982 are excluded.<\/strong><\/p>\n<p><strong>35.3\u00a0\u00a0Subject to paragraph 35.1:<\/strong><\/p>\n<p><strong>35.3.1\u00a0\u00a0we shall not be liable to you,<\/strong>\u00a0whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, or any indirect or consequential loss arising under or in connection with any contract between us; and<\/p>\n<div id=\"36\"><\/div>\n<p><strong>35.3.2\u00a0\u00a0our total liability to you<\/strong>\u00a0or all other losses arising under or in connection with any contract between us, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be limited to \u00a3500..<\/p>\n<p><strong>36.\u00a0\u00a0How We May Use Your Personal Information<\/strong><\/p>\n<div id=\"37\"><\/div>\n<p>How we will use your personal information. We will only use your personal information as set out in our\u00a0<a href=\"https:\/\/www.mozillion.com\/pages\/privacy-policy\">Privacy Policy<\/a>.<\/p>\n<p><strong>37.\u00a0\u00a0Other Important Terms<\/strong><strong>\u00a0\u00a0<\/strong><\/p>\n<p><strong>37.1\u00a0\u00a0We may transfer this Agreement to someone else<\/strong>. We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the terms.<\/p>\n<p><strong>37.2\u00a0\u00a0You need our consent to transfer your rights to someone else<\/strong>. You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing. For the avoidance of doubt the warranty supplied with the handset is not transferrable.<\/p>\n<p><strong>37.3\u00a0\u00a0Nobody else has any rights under this contract (except someone you pass your guarantee on to<\/strong>). This contract is between you and us. No other person shall have any rights to enforce any of its terms, except as explained in paragraph 37.2 in respect of our guarantee. Neither of us will need to get the agreement of any other person in order to end the contract or make any changes to these terms.<\/p>\n<p><strong>37.4\u00a0\u00a0If a court finds part of this contract illegal, the rest will continue in force<\/strong>. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.<\/p>\n<p><strong>37.5\u00a0\u00a0Which laws apply to this contract and where you may bring legal proceedings if you are a consumer<\/strong>. These terms are governed by English law and you can bring legal proceedings in respect of the devices in the English and Welsh courts. If you live in Scotland you can bring legal proceedings in respect of the devices in either the Scottish or the English and Welsh courts. If you live in Northern Ireland you can bring legal proceedings in respect of the devices in either the Northern Irish or the English and Welsh courts.<\/p>\n<div id=\"38\"><\/div>\n<p><strong>37.6\u00a0\u00a0Which laws apply to this contract and where you may bring legal proceedings if you are a business<\/strong>. If you are a business, any dispute or claim arising out of or in connection with a contract between us or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales and the courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim.<\/p>\n<p><strong>38.\u00a0 Postage &amp; Packaging: Sending Items to Mozillion<\/strong><\/p>\n<p><strong>38.1 Phones and devices must be packaged in accordance with our packaging instructions to ensure safe and successful delivery to us.<\/strong><\/p>\n<p><strong>38.2<\/strong>\u00a0As we are not the legal owner of the goods at time of you sending the device(s) to us, our ability to make claims for loss or stolen items on your behalf maybe impacted as a result. We do not accept responsibility for loss of goods from third party providers, but will assist you (in the rare cases where this is required) where we are able.<\/p>\n<p><strong>38.2.1<\/strong>\u00a0For the avoidance of doubt, please note you will be covered up to:<\/p>\n<ul>\n<li>\u00a3100.00 with DPD<\/li>\n<li>\u00a3150.00 tracked 48 with Royal Mail<\/li>\n<li>\u00a3750.00 special delivery with Royal Mail (this will be subject to you filing the claim)<\/li>\n<\/ul>\n<p>We recommend if you have an order of significant value that you use the Royal Mail special delivery.<\/p>\n<p><strong>38.3<\/strong>\u00a0If you believe that your package being sent to Mozillion (including but not limited to phones sold on Mozillion\u2019s platform and returns that you have purchased and are returning to us) has been lost, damaged or stolen (subject to our confirmation that we have not received your package) you will be required to provide a valid returns or postage receipt which you will have been provided with by the relevant carrier.<\/p>\n<p><strong>38.4<\/strong>\u00a0It is your responsibility to obtain a receipt from the carrier regardless of which postage service you use, including but not limited to any provided by Mozillion, and retain this for tracking and insurance purposes. As part of the claims process, you may be required to provide the serial number and\/or IMEI number of any items contained in your package (along with proof of purchase). You can find the IMEI of a mobile phone by calling *#06# or by going into your device settings. If you can\u2019t provide a valid returns receipt, proof of purchase and serial\/IMEI number, you may not be able to claim for any loss or damage to your package (subject to our confirmation that we have not received your package).<\/p>\n<p><strong>38.5<\/strong>\u00a0You must notify us in writing of any loss or damage, within seven (7) days of the date on which your package was accepted by the carrier. This is so we can assist you in making a claim if required within the deadlines set by third party carriers.<\/p>\n<p><strong>38.6<\/strong>\u00a0It is your responsibility to raise a claim with the carrier for lost, damaged or stolen packages. Mozillion have no obligation to submit a claim to the carrier on your behalf but will assist you where we are able.<\/p>\n<p><strong>38.7<\/strong>\u00a0If you have used a postal service provided by Mozillion and fail to provide a valid receipt within seven (7) days of the date of your returns receipt, we have no obligation to assist with a claim to the carrier on your behalf.<\/p>\n<p><strong>38.8<\/strong>\u00a0We shall be entitled to make our own investigations as we deem necessary to satisfy ourselves of the validity of any claims.<\/p>\n<div id=\"39\"><\/div>\n<p><strong>38.9<\/strong>\u00a0In calculating the value of any claim we shall accept no other valuations than our own for the items that you may be claiming for and under no circumstances do we accept any liability for any other loss, damage or compensation resulting from the use of our Delivery Services.<\/p>\n<p><strong>39.0<\/strong>\u00a0We will notify you in writing of the outcome of our investigation and, if any claim is successful, payment of the valuation will be made via the payment method specified in your account on our\u00a0<a id=\"sim_terms\"><\/a>website.<\/p>\n<p>&nbsp;<\/p>\n<h4>Mozillion SIM only, Pay as you go Preloaded SIMs &amp; Airtime Plan Terms and Conditions<\/h4>\n<p><strong>1. These Term and Conditions (Ts&amp;Cs)<\/strong><\/p>\n<p>We\u2019re Mozillion Limited, a company registered in England and Wales with company number 11864919. Our registered office address is Mozillion, 15 West Street, Brighton, England, BN1 2RL. In these Ts&amp;Cs references to \u201cMozillion Mobile\u201d, \u201cMozillion\u201d or \u201cwe\u201d all mean Mozillion Limited.<\/p>\n<p>These Ts&amp;Cs will apply to you when you place an order on the Mozillion website https:\/\/www.mozillion.com) (the Mozillion Website) or use an Mozillion SIM Card (SIM) or Mozillion Airtime Plan (Airtime Plan, Mozillion Plan, Plan). Separate terms apply to the use of the website and our blog, which you can find on our site.<\/p>\n<p>These Ts&amp;Cs include important information on how we provide you with your mobile service and what to do if there is a problem. If you do not agree to these Ts&amp;Cs then please do not order a Mozillion Plan from us or stop using Mozillion\u2019s services.<\/p>\n<p><strong>2. How to contact us<\/strong><\/p>\n<p>The fastest way to contact us is through email to\u202fhelp@mozillion.com.<\/p>\n<p><strong>3. Your Mozillion Airtime Plan<\/strong><\/p>\n<p>Your Mozillion Plan starts from the activation date which is normally the day of your order. SIMs are normally delivered within 1-2 working days of your order, but please let us know if your SIM doesn\u2019t arrive.<\/p>\n<p>When you order a Mozillion Plan the price for your airtime plan will be emailed to you and will be shown in the Mozillion email confirmation. Payments are taken in advance of the service commencing each billing period. If your payments are late or overdue we may suspend or terminate your plan with immediate effect. We will attempt to notify you in advance of this happening.<\/p>\n<p>Airtime Plans are for normal person to person use from a mobile phone (unless Plan is a Data-only plan) and are subject to your acceptance of our Terms and Conditions. We monitor use in accordance with those terms.<\/p>\n<p>Plans are also not to be used for anything unlawful or to send nuisance communications. We are free to decide that other types of use may also be breaking this term. If you do break this term, we\u2019ll contact you and ask you to stop and if you don\u2019t then we may disconnect and terminate your SIM card from our network.<\/p>\n<p>All Mozillion Plans are subject to Fair Use Policies and Guidelines as outlined in clauses 10 and 11 of these Ts&amp;Cs.<\/p>\n<p><strong>Minutes and texts:<\/strong>\u202fCalls and texts to numbers starting with 08, 070, 09 and 118 are not included in your inclusive allowance of minutes and texts. Premium rate SMS\/texts and calls are not included in your inclusive allowance of minutes and texts (for these premium rate services a credit top-up allowance is required if available).<\/p>\n<p><strong>4G Calling:<\/strong>\u202fYou\u2019ll need a 4G calling compatible phone to make and receive calls over our 4G network. 4G Calling is not available when roaming.<\/p>\n<p><strong>Wi-Fi Calling:<\/strong>\u202fWhen in the UK, if you have a compatible device and the correct software, you can use your minutes allowance to make calls using Wi-Fi Calling.<\/p>\n<p><strong>Data:<\/strong>\u202fYou\u2019ll need 4G or 5G coverage (and so on as new technologies are introduced) to use mobile internet on your phone plus a compatible device. You\u2019ll need to be in range of our network provider\u2019s base stations: to use our 4G network you need to be within a 4G-enabled area and to use 5G you need to be within a 5G-enabled area. You must have a 5G compatible device to access 5G.<\/p>\n<p><strong>Data-only Plans:\u202f<\/strong>A Data-only plan is a plan that does not include any call minutes or text allowance.<\/p>\n<p><strong>3.1<\/strong>\u202fYou can and should check expected coverage via our coverage maps at mozillion.com\/resources\/help\/coverage-checker\/. Your phone may not be compatible with other UK networks or networks outside the UK.<\/p>\n<p>Coverage and speeds will vary depending on your location, the number of people on the network and other factors such as weather and geography. In some very limited circumstances right at the edge the 5G-enabled area and when you are indoors, your device may show you\u2019re connected to the 5G network when you\u2019re not.<\/p>\n<p>You\u2019ll still receive our best available speed at this location.<\/p>\n<p><strong>3.2<\/strong>\u202fEach plan gives you a data allowance to use each month. If you have a plan with a capped data allowance we\u2019ll let you know by text message when your data is running low (when 80% of your allowance is used up) and when it has run out.<\/p>\n<p><strong>4. Problems with our service<\/strong><\/p>\n<p>If our supply of your mobile service or the delivery of your phone is interrupted by an event outside our control then we\u2019ll contact you as soon as possible and try to minimise the interruption. As long as we have tried to minimise the interruption we won\u2019t be liable for short term interruptions to your mobile service or short delays in the delivery of your phone. If the interruption continues you might be able to cancel your Mozillion Plan under section 6.<\/p>\n<p><strong>5. Service Issues<\/strong><\/p>\n<p>If we need to suspend our services (e.g. to resolve technical problems or to implement important change in law or in our regulatory requirements), then we\u2019ll contact you to let you know. We\u2019ll be able to let you know in advance of any suspension unless it\u2019s an emergency, in which case we\u2019ll let you know as soon as reasonably possible. If we need to suspend our services for more than a few days we\u2019ll refund you for the days you weren\u2019t able to use your Mozillion Plan.<\/p>\n<p>If our network is experiencing high demand or unusually high traffic we might need to slow down the speed of your mobile service. We might also need to suspend or terminate your mobile service if we think your use of the mobile service is affecting the network or other users.<\/p>\n<p>If you\u2019re making calls using your internet connection (for example by using Skype or WhatsApp to make calls), and you make a call to the emergency services, the emergency services may not be able to find your location. To ensure that the emergency services can find you, make sure you use your normal phone service to call the emergency services.<\/p>\n<p><strong>6. If there is a problem with your Mozillion Plan<\/strong><\/p>\n<p>If there is a problem with your Mozillion Plan or new phone, please contact us using the details above.<\/p>\n<p>We\u2019re responsible for providing our mobile service and any phone you order from us in a way which complies with this contract, and you have legal rights where our mobile service or the phone we have supplied is not as we have described or is faulty.<\/p>\n<p><strong>7. Ending the contract<\/strong><\/p>\n<p>You can cancel your Mozillion Plan within 14 days of purchase (regardless of whether you have ordered a 1-month, 12-month or 24-month SIM). If you cancel during this 14-day period we\u2019ll refund you for your Mozillion Plan less the days that have lapsed.<\/p>\n<p>You can end your 1 month rolling SIM plan by giving 30 days\u2019 notice at any time or by using a PAC code to leave us. If you use a PAC code to leave us you will still be liable for an early termination fee of 30 days, being the cost of the original rolling monthly plan.<\/p>\n<p>You can end your 12-month SIM plan at the end of the 12-month period, by giving us 30 day\u2019s notice before the end of your 12 month plan. You can end your 24-month SIM plan at the end of the 24 month period, by giving us 30 days notice before the end of your 24 month plan. If you do not terminate either of the 12- and 24-month plans at the end of the term, these will automatically become 1 month rolling plans, which will require 30 day\u2019s notice to cancel or port your number to another network.<\/p>\n<p>If your port out or terminate your 12 or 24 month plan early, you will be subject to a cancellation charge for the remainder of the term. An example of a cancellation charge, you have a 12 month plan at \u00a320 per month, you terminate by porting out at month 9, leaving 3 months outstanding, which is 3 x \u00a320, equalling a \u00a360 cancellation charge, including VAT. You will be liable to pay Mozillion any balance outstanding for 12 and 24 month plans.<\/p>\n<p>If we believe you (or any user of your Plan) are using or will use your Plan for commercial use, or fraudulently, illegally, to make nuisance, spam or automate calls\/SMS, to threaten, harass, stalk, abuse, disrupt or otherwise violate or infringe the rights of others or in a way that harms our network or the experience of other users then we can terminate your Mozillion Plan straightaway.<\/p>\n<p>Please note there are no partial refunds for unused allowance.<\/p>\n<p>You can end your Mozillion Plan if we have breached these Ts&amp;Cs, if we don\u2019t provide the Mozillion Plan to you for a period of time or if we make a significant change to the way we provide you with your Mozillion Plan. If you end your Mozillion Plan for any of these reasons you\u2019ll get a refund for any unused days on your Mozillion Plan that you have paid for but not received.<\/p>\n<p>If we believe you (or any user of your Plan) are using or will use your Plan for commercial use, or fraudulently, illegally, to make nuisance, spam or automate calls\/SMS, to threaten, harass, stalk, abuse, disrupt or otherwise violate or infringe the rights of others or in a way that harms our network or the experience of other users then we can terminate your Mozillion Plan straightaway.<\/p>\n<p>If you or the phone number allocated to you appear on a consumer protection list, we have the right to end your Mozillion Plan and to withdraw your number.<\/p>\n<p><strong>8. Our responsibility to you<\/strong><\/p>\n<p>Nothing in these Ts&amp;Cs will limit or exclude our liability for death or personal injury caused by our negligence (including the negligence of our employees, agents or subcontractors), or to the extent our liability cannot be excluded or limited under applicable law.<\/p>\n<p>If you\u2019re a consumer, nothing in these Ts&amp;Cs will affect your legal rights as a consumer.<\/p>\n<p>If you\u2019re a business, we exclude all implied terms that may apply to our site or any content on it and we will not be liable for loss of profits, business, or revenue, business interruption, loss of anticipated savings, or reputation, or any indirect or consequential damage.<\/p>\n<p><strong>9. Other important terms<\/strong><\/p>\n<p>We will only use your personal information as set out in our Privacy Policy.<\/p>\n<p>If you have a complaint which we\u2019ve not been able to resolve you can ask for it to be resolved using alternative dispute resolution. Alternative dispute resolution is a process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court.<\/p>\n<p>These Ts&amp;Cs are governed by English law and you can bring legal proceedings in the English courts. If you live in Scotland you can bring legal proceedings in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in either the Northern Irish or the English courts.<\/p>\n<p>You must not engage in the organised, fraudulent resale of our Services. If we reasonably suspect you to be doing so, we reserve the right to take appropriate action to stop such resale.<\/p>\n<p><strong>10. Roaming in the EU and selected destinations<\/strong><\/p>\n<p>All our members have certain usage obligations which we ask that they consider as part of use of our Service in relation to our EU and selected destinations roaming. Generally speaking, these obligations require your use of our services to be for private, personal, and non-commercial purposes as we mention in our Terms and Conditions unless you have a business plan, but also extend to how you use roaming abroad.<\/p>\n<p>This Fair Usage Policy explains your usage obligations when roaming in the EU and selected destinations, how to avoid breaching these obligations and what will happen if your usage breaches these obligations and falls outside this Fair Usage Policy.<\/p>\n<p>Fair Usage EU and Selected Destinations Roaming Cap:\u202fPlans that include 1GB of data: 50% of your monthly data allowance can be used in Zone 1. Plans that include 3GB, 10GB, 30GB or 100GB: 25% of your monthly data allowance can be used in Zone 1. Unlimited data plans: 25GB of your monthly data allowance can be used in Zone 1. Mozillion reserves the right to modify this fair-usage policy or the zone plan at its sole discretion should excessive usage appear on any plan for a significant period.<\/p>\n<p>Zone 1 countries and destinations:\u202fSpain, France, Portugal, Ireland, Greece, Poland, Italy, Germany, Netherlands, Bulgaria, Cyprus, Switzerland. Belgium, Sweden, Croatia, Hungary, Malta, Lithuania, Romania, Finland, Czech Republic, Norway, Slovakia, Austria, Denmark, Gibraltar, Iceland, Latvia, Estonia, Luxembourg, Guadeloupe, Slovenia, Liechtenstein, French Guiana, Guernsey, Isle of Man, Jersey, Martinique, R\u00e9union, San Marino, Faroe Islands.<\/p>\n<p>Speeds when roaming: All our customers can enjoy the superfast speeds supported by our roaming partners abroad. But please note: Speeds outside the UK always depend on the network you connect to and 4G and 5G may or may not be available. We aren\u2019t responsible for the speeds or coverage you get outside the UK. As in the UK, your coverage and speeds will vary depending on your location, the number of people on the network and other factors such as weather and geography.<\/p>\n<p><strong>10.1. Your obligations<\/strong><\/p>\n<p>You may only use our services in the EU and our other selected destinations (excluding the UK) for periodic travel, like holidays or short breaks. Once you reach the Fair Usage EU and Selected Destinations Roaming Cap you will not be able to use your data in the EU and other selected destinations (Zone 1).<\/p>\n<p><strong>10.1.1. What to avoid:<\/strong><\/p>\n<p>Using our services for the first time outside of the UK, using a large volume of your allowance (be that text, calls or data) in the EU and our other selected destinations (excluding the UK), or using our services and travelling within the EU and our other selected destinations (excluding the UK) for prolonged periods which don\u2019t follow reasonable consumer holiday and travel patterns and behaviour. If you use our services outside the UK in the EU and our other selected destinations for 63 or more days in any four-month period and you cannot demonstrate prevailing use or presence in the UK this is likely to be deemed to be an unfair use of our services. When this happens charges will apply (see below), but we will always contact you 14 days before this time to make you aware of this. These charges will cease to apply when your behaviour is in accordance with this policy.<\/p>\n<p>Please remember that the examples above aren\u2019t an exhaustive list of how you could be breaching our Fair Usage Policies. Other activities which we reasonably believe to be outside of legitimate consumer use may also be subject to the terms in the Fair Usage Policies outlined in clause 10 and 11.<\/p>\n<p><strong>11. Fair Use Policy<\/strong><\/p>\n<p><strong>11.1. Calls, Texts and Data:<\/strong><\/p>\n<p>Mozillion Airtime Plans are based on reasonable assumptions of average \u2018personal\u2019 mobile usage only, considering comparable statistics from comparable service providers in the UK. In case of non-personal, used for commercial, abnormal, abusive, fraudulent or unreasonable usage is detected, Mozillion reserves the right to suspend the availability of the Airtime Plan, increase the price of any Airtime Plan, move the subscriber to a different airtime plan and\/or disconnect\/terminate the SIM, having attempted to contact you first.<\/p>\n<p>Such usage may include but is not limited to usage of plans in permanent roaming (or with abnormally high roaming compared to national usage), regular tethering to multiple different devices, abnormally high usage compared to industry standards, use of unauthorised equipment for which this Plan is not intended for (including but not limited to GSM Gateways, commonly known as a \u2019SIM box\u2019, modems, and Wi-Fi routers), or any other excessive usage on a given plan for a significant period.<\/p>\n<p><strong>11.2. Data<\/strong><\/p>\n<p>Mozillion considers data usage to be for personal use, non-commercial use only, and therefore and have the right to apply traffic management controls to deprioritise the subscriber&#8217;s mobile traffic or reduce data speeds and\/or to move the subscriber to another plan if applicable. This includes unlimited data plans where usage exceeds 500GB in a single calendar month, or where a user is regularly tethering multiple devices.<\/p>\n<p>Mozillion reserves the right to modify these policies and guidelines at any time.<\/p>\n<p><strong>11.3 Consequences if your usage falls outside this Fair Use policy<\/strong><\/p>\n<p>Calls, texts and data. If we suspect you are not acting in accordance with our policies, we reserve the right to impose further charges as per our current <a href=\"https:\/\/www.mozillion.com\/out-of-bundle-price-guide.pdf\" target=\"_blank\" rel=\"noopener\">Out of Bundle price guide<\/a> and\/or disconnect your SIM card and\/or your plan at any time, having attempted to contact you first.<\/p>\n<p><strong>12. Complaints<\/strong><\/p>\n<p><strong>12.1. Process:\u202f<\/strong>If you ever want to complain about our Products or Services, we will endeavour to handle such complaints fairly, efficiently and confidentially. Please visit Mozillion&#8217;s website for details of our Complaints Code, process and methods of contacting us which can be found at\u202fhttps:\/\/www.mozillion.com\/resources\/help\/complaints.<\/p>\n<p><strong>13. Replacement SIM cards and eSIMs<\/strong><\/p>\n<p>If a SIM Card or eSIM is lost, stolen, damaged or needs to be swapped for an alternative SIM type, you should contact customer services for a new one. We may charge \u00a33 for a replacement SIM, including eSIMs.<\/p>\n<p><strong>14.Responsible use for preloaded, pas you go, pay monthly sim only plans and data only sim plans.<\/strong><\/p>\n<p>14.1 You may only use Mozillion Services:<\/p>\n<p>(a) As laid out in this agreement; and<\/p>\n<p>(b) For your own personal, non-commercial use. This means you must not resell or commercially exploit any of Our services<\/p>\n<p>or content.<\/p>\n<p>(c) You must be 16 years or older to hold an account with Mozillion.<\/p>\n<p><strong>14.2 You must not use Mozillion Services, the SIM or Mozillion phone number or allow anyone else to use Our services, the SIM<\/strong><\/p>\n<p><strong>or Mozillion phone number for illegal or improper uses. For example:<\/strong><\/p>\n<p>(a) For fraudulent, criminal or other illegal activity or unsolicited bulk or commercial communications or other unauthorised<\/p>\n<p>communications, or knowingly send any viruses;<\/p>\n<p>(b) In any way which breaches another person\u2019s rights, including copyright or other intellectual property rights;<\/p>\n<p>(c) To copy, store, modify, publish or distribute Our services or their content, except where we give you permission;<\/p>\n<p>(d) To download, send or upload content of an excessive size, quantity or frequency. We\u2019ll contact you if your use is excessive;<\/p>\n<p>(e) In any way which breaches any security or other safeguards or in any other way which harms or interferes with our\u202f network, the networks or systems of others or Our services; or<\/p>\n<p>(f) To use or provide to others any directory or details about our customers.<\/p>\n<p><strong>14.3 You must co-operate with us and follow our reasonable instructions to ensure the proper use and security of your account.<\/strong> This<\/p>\n<p>includes (but is not limited to) any instructions from us to update the settings on your device in which you\u2019re using our SIM.<\/p>\n<p><strong>14.4 We may publish additional policies<\/strong> which will provide more details about the rules for use of certain of Our services in order to\u202f ensure that:<\/p>\n<p>(a) The use of Our service is not excessive;<\/p>\n<p>(b) To combat fraud; and<\/p>\n<p>(c) Where the Service we offer, or may introduce, require certain rules to ensure they can be enjoyed by our customers.<\/p>\n<p>If we publish such a policy, we\u2019ll let you know you know by publishing it on our website, mozillion.com such a policy may\u202f be amended from time to time, for instance, if we discover that Our service is being used for fraudulent purposes, or\u202f excessive use of Our service is causing problems for us, our systems, or for other users, or if we introduce new Services<\/p>\n<p>which require certain rules to ensure that such new Services can be enjoyed by our customers. Again, we will update\u202fthe policy on our website.<\/p>\n<p><strong>Responsible use \u2013 How you use the Messaging Service<\/strong><\/p>\n<p><strong>14.5 While using the Messaging Service, you must not send or upload:<\/strong><\/p>\n<p>(a) Anything that is copyright protected, unless you have permission;<\/p>\n<p>(b) Bulk or commercial communications or other unauthorised communications, or knowingly send any viruses; or<\/p>\n<p>(c) Anything that is obscene, offensive, abusive, defamatory, menacing, harassing, threatening or is unlawful in any other way.<\/p>\n<p>14.6 We may put limits on the use of certain Services, such as Messaging Services. For example, we may limit the size of messages\u202f or storage space.<\/p>\n<p>14.7 While we have no obligation to monitor the Messaging Service, if you use the Service in a manner that we deem contrary to\u202fnormal consumer activities, we reserve the right to stop your Service without notice. You may still be charged for any content\u202fwhich is blocked or removed.<\/p>\n<p><strong>Responsible use \u2013 How you use Age Restricted Service<\/strong><\/p>\n<p><strong>14.8 If you\u2019re under 18, you\u2019re not permitted to access our Age Restricted Service.<\/strong> If you\u2019re 18 or over and you access the Age Restricted Service, you must not show or send content from the Age Restricted Service to anyone under 18. You must also<\/p>\n<p>ensure that you have deactivated any access to Age Restricted Service if you let anyone under 18 use your device.<\/p>\n<p><strong>14.9 You accept that we cannot control access to Age Restricted Services obtained over WiFi.<\/strong><\/p>\n<p><strong>Responsible use \u2013 Data Only Plans personal<\/strong><\/p>\n<p><strong>14.10 Our Data Only SIM plans are for personal, non-commercial use only<\/strong> and can be used in SIM enabled tablets or laptops and portable mobile WI-FI devices. This SIM should not be used as a permanent long-term alternative to home broadband. If we determine in our sole opinion that your use of the Mozillion Services is in breach of these Terms and Conditions and\/or exceeds that reasonably expected of someone using the Service for legitimate personal, non-commercial use, then we may at our discretion terminate (in accordance with Section 16), or Suspend (in accordance with Section 15), or restrict your Mozillion Service. As an example, without limitation, we consider that if you regularly tether more than 5 devices that this is unlikely to be legitimate personal, non-commercial use.<\/p>\n<p><strong>Responsible use \u2013 Voice Plans<\/strong><\/p>\n<p><strong>14.12 Our Voice Plans are for personal, non-commercial use only<\/strong> and can be used in SIM enabled mobile devices, tablets laptops\u202f and portable mobile WI-FI devices. This SIM should not be used as a permanent long-term alternative to home broadband.<\/p>\n<p>If we determine in our sole opinion that your use of the Mozillion Services is in breach of these Terms and Conditions and\/or\u202fexceeds that reasonably expected of someone using the Service for legitimate personal, non-commercial use, then we may\u202f at our discretion terminate (in accordance with Section 16), or Suspend (in accordance with Section 15), or restrict your Mozillion Service. As an example, without limitation, we consider that if you regularly tether more than 5 devices that this is\u202funlikely to be legitimate personal, non-commercial use.<\/p>\n<p><strong>15. Suspension of your Service<\/strong><\/p>\n<p><strong>15.1 We may Suspend any or all of Our services you use without notice if:<\/strong><\/p>\n<p>(a) We reasonably believe you have provided us with false or misleading details about yourself.<\/p>\n<p>(b) Your use of Our services is excessive (as may be defined in accordance with Section 14 above), is<\/p>\n<p>causing problems for other users, and you\u2019re continuing to use Our services excessively;<\/p>\n<p>(c) We believe your SIM has been lost, stolen or is being used in a way not permitted by this agreement;<\/p>\n<p>(d) We reasonably believe that you have used Our services, the SIM(s) or a Mozillion phone number for illegal or\u202fimproper purposes in contravention of our responsible use requirements in Section 14 above;<\/p>\n<p>(e) We receive a serious complaint against you which we believe to be genuine (for example, if we receive a complaint\u202fthat you\u2019re using Our services in any of the ways prohibited in Section 14)<\/p>\n<p>(f) We\u2019re required to Suspend your Service by the emergency services or other government authorities.<\/p>\n<p>(g) You have not activated an Add-on on your account or undertaken any chargeable events or activities (for example,\u202fmade telephone calls, sent text or photo messages, accessed content or the internet or any other Our services for\u202f which a charge is made) using any credit or allowance on your account within the preceding 6-month period.<\/p>\n<p>(h) If you fail to pay for your next month\u2019s plan on or before the Renewal Date.<\/p>\n<p>(j) If we have identified that you have used Our services outside of the UK for a continuous period of 60 days or longer\u202fin a rolling 12-month period.<\/p>\n<p>(K) Pay Monthly Plus 12- and 24-month plans, if your monthly payment is declined, we will suspend your airtime services. If payment is not made within 30-days to lift the suspension, your plan will be terminated as per section 16.<\/p>\n<p><strong>16. Ending this agreement and Disconnection of your Service<\/strong><\/p>\n<p><strong>16.1 <\/strong>You may end this agreement by stopping your use of the Service at any time as per section 7 above.<\/p>\n<p><strong>16.2 <\/strong>If you choose to end this agreement for any reason, outside of the 14-day cooling off period, you will not be entitled\u202fto any pro-rated refund of your monthly plan charge, any upfront payment or any wallet credit. Any credit within the wallet will be forfeited.<\/p>\n<p>For the avoidance of doubt, we are not obliged to refund any upfront payment made for Pay Monthly Plus plans, and Preloaded Pay as you go sim plans, with regard to section 14.<\/p>\n<p><strong>16.3<\/strong> You can request a PAC (to leave and take\/port your number to another provider) or STAC (to switch to another provider\u202f without taking your number \u2013 although please make sure that you want to do this as a terminated number cannot be\u202freversed) You can text PAC to\u202f65075 or STAC to 75075.<\/p>\n<p><strong>16.4 We may end this agreement in the following ways:<\/strong><\/p>\n<p>(a) On 30 days\u2019 notice. We can end this agreement by giving you at least 30 days\u2019 notice. Your agreement will finish at\u202f the expiry of the 30-day notice period or a later date which we specify.<\/p>\n<p>(b) For non-payment of your Service. No refunds will be given for any upfront payments made on Pay Monthly Plus plans. The upfront payments is forfeit due to non-payment of the monthly fee, resulting in termination.<\/p>\n<p>(c) Because of your conduct.<\/p>\n<p>(d) In the following cases, we may end your agreement immediately:<\/p>\n<p>(i) if we have the right to Suspend your Service on any of the grounds in Section 15 and we believe that the grounds\u202fare serious and have not been, or are unlikely to be, rectified;<\/p>\n<p>(ii) if we believe that your communications or actions with regard to our Customer Support or any of our retailers, affiliates or\u202f agents, or your use of Our service, are jeopardising the operation of the network, or are of an unacceptable nature.<\/p>\n<p>(iii) in the event of your death; or<\/p>\n<p>(iv) where you have used the Service in a way not consistent with the ordinary use of a consumer.<\/p>\n<p>(e) No network access for our Service. We may end your agreement if we no longer have access to other operators\u2019\u202f networks which we need to provide Our service, or if we are no longer able to provide Our service due to factors beyond our control or because we cease business. If reasonably possible under these circumstances, we\u2019ll endeavour to\u202fprovide you with such notice as is practical.<\/p>\n<p><strong>17. Effect of this agreement ending<\/strong><\/p>\n<p><strong>17.1<\/strong> If this agreement ends, we\u2019ll close your account and disconnect you and you\u2019ll not be able to use Our service. In addition,<\/p>\n<p>you\u2019ll lose your phone number unless you have made a request for your number to be ported prior to Disconnection.<\/p>\n<h4 id=\"travel_terms\">Travel SIM Terms and Conditions<\/h4>\n<p><strong>1. Summary<\/strong><\/p>\n<p>The characteristics of the travel data eSIM operated by Mozillion Ltd are described on the Mozillion website before you can subscribe to the service. You are not subject to any contract duration commitment and can cancel your subscription to the service at any time. The Services may be embedded into different kind of device, including (without limitation): a connected car, a laptop, a tablet or an equivalent device from an authorized original equipment manufacturer, etc. (\u201cDevice\u201d).<\/p>\n<p><strong>3. The Service consists in providing prepaid cellular Data Plans (allowance of data valid for a certain duration) to enable connecting your Device to the Internet (the \u201cData Plans\u201d). The countries in which You can use the Data Plans are listed where You browse through available offers. Available offers may change from time to time and may depend on the country You are currently in. By purchasing the Service, You agree that You are authorized to use the Service and are responsible for paying for the Service per these T&amp;C\u2019s.<\/p>\n<p>These T&amp;C\u2019s, including the provisions regarding the personal data protection referenced herein (collectively, the \u201cAgreement\u201d), set forth the T&amp;C\u2019s that apply to your use of the Service. \u201cCustomer\u201d, \u201cYou\u201d and \u201cyour\u201d mean the customer of the Service defined above, and \u201cMozillion\u201d, \u201cwe\u201d, \u201cour\u201d, and \u201cus\u201d include Mozillion Limited and any of its affiliates involved in providing You with the Service. Unless otherwise provided in this Agreement, all such modifications or amendments shall be effective immediately upon posting on www.mozillion.com (the \u201cWebsite\u201d). Where we make a significant change to this Agreement, we will endeavor to separately notify You about this change. YOUR CONTINUED USE OF THE SERVICE AFTER THE POSTING ON THE WEBSITE WILL BE CONCLUSIVELY DEEMED TO BE ACCEPTANCE BY YOU OF ANY SUCH MODIFICATIONS OR AMENDMENTS.<\/p>\n<p>To support the Service, Mozillion has entered into agreement with various cellular carriers (mobile operators) around the world to access their cellular networks (collectively referred to as the \u201cMobile Network\u201d). In providing the Service Mozillion is not providing You with a phone number, and is not providing You the ability to place or receive voice telephone calls (including calls to 911 and other emergency numbers) or send or receive SMS or text messages.<\/p>\n<p><strong>4. Agreement<\/strong><\/p>\n<p>This Agreement will commence, and a binding contract will exist between Mozillion Ltd and the Customer when the Customer starts using the Service. It will continue until terminated as set forth herein. The Service is sold exclusively on a prepaid basis.<\/p>\n<p>All services, including any related offers and promotions may be subject to specific additional T&amp;C\u2019s. Please check our Website regularly as these T&amp;C\u2019s are updated from time to time.<\/p>\n<p>You will remain responsible to us under this Agreement for the actions of any other person You allow to use the Services on your account.<\/p>\n<p><strong>5. Our obligations<\/strong><\/p>\n<p>Mozillion Ltd will provide the Service in accordance with the Agreement, and as per the applicable Data Plan description, and from the date the Customer starts using the Service or purchases such Data Plan. We will try to make sure that the Service is available to You wherever possible; however both availability and quality of the Service may be affected by things we cannot control such as physical obstructions, atmospheric conditions and outages on the Mobile Network (the infrastructure, software and hardware enabling a cellular carrier \/ mobile operator to support wireless internet services offered to subscribers) where such outages and their remedies are not within our control. We or our mobile operator partners (any company operating a mobile internet network, which owns or controls all the elements necessary to sell and deliver mobile internet services) may from time to time need to carry out upgrade or maintenance work on the Mobile Network which may affect the availability and\/or quality of the Service. We will endeavour to keep such disruption to a minimum, but this may not always be within our control.<\/p>\n<p>We shall provide the Service with reasonable skill and care, and we shall use reasonable efforts to make the Service available to You. If You experience problems with our Service or suspect fraudulent activity on your account, please contact the Customer Service immediately.<\/p>\n<p>We may from time to time and without notice, change the Service in order to comply with safety, regulatory, statutory and other requirements. We will try to ensure that this does not materially affect the scope of the Service.<\/p>\n<p><strong>6. Your obligations<\/strong><\/p>\n<p>You must use the Service in accordance with this Agreement and any other reasonable instructions we or the Customer Service give You from time to time. In particular, You are not authorized to use the (e)SIM card in any other device than the Device it was delivered with or supposed to be used with (if not delivered with the (e)SIM card). It is also clarified that the (e)SIM card remains the property of Mozillion Ltd and\/or its chosen partners. You must disclose your country and residence to us when You open your Account.<\/p>\n<p>According to applicable laws, You may have to provide us with a copy of your ID (national ID card or passport) before You first begin to use the services or at the latest within fifteen (15) days from the date You start using the Service. If not we reserve the right to suspend immediately the services.<\/p>\n<p>The (e)SIM card does not have a PIN code by default. YOU ARE SOLELY RESPONSIBLE FOR CONTROLLING THE ACCESS TO YOUR (e)SIM CARD, AND YOU AGREE TO PAY FOR THE SERVICE WHETHER OR NOT YOU HAVE AUTHORIZED SUCH USE. WE SHALL NOT BE HELD RESPONSIBLE FOR FRAUDULENT USE OF YOUR (e)SIM CARD. If You believe that your (e)SIM card is being used in an unauthorized manner, You must contact the Customer Service immediately so that the appropriate modifications can be made to your account.<\/p>\n<p>The (e)SIM card is attributed to the first Device owner. The first Device owner remains liable for its use at any time unless Mozillion Ltd has received a proof of the change of the Device\u2019s ownership. The Service is intended to be used for web browsing, email, uploading and downloading applications and content to and from the Internet or third-party applications, and using applications and content without excessively contributing to network congestion.<\/p>\n<p>You will not use the Service for any unlawful, abusive or fraudulent purpose, including, for example, using the Service in a way that (1) interferes with our ability to provide Service to You or other customers; (2) abuses any bonus or promotional program; or (3) avoids your obligation to pay for the Service. You will not use the Service in a way that compromises network security or capacity, excessively and disproportionately contributes to network congestion, adversely impacts network service levels or legitimate data flows, degrades network performance, causes harm to the network or other customers.<\/p>\n<p>You will not take any action that would, in Mozillion\u2019s sole determination, interfere with the Service or other Mozillion customers, infringe the rights of any third party, or otherwise constitute objectionable conduct. If we have reasons to believe that You or someone else using your (e)SIM card is abusing the Service or otherwise breaching this Agreement, we may immediately suspend, restrict, or cancel your (e)SIM card and your ability to use the Service without notice. In addition, we reserve the right, at our sole discretion and for any reason, to (a) suspend, restrict, modify or terminate your (e)SIM card and your access to and use of the Service and\/or (b) refuse to allow You to buy any new Data Plans. You are responsible for all charges incurred on your account whether or not they are incurred by You personally except those incurred after You have notified the Customer Service of the loss or theft of your (e)SIM card, and the Customer Service has acknowledged it in writing.<\/p>\n<p><strong>7. Eligibility<\/strong><\/p>\n<p>If You are under 18 years old, your parent or legal guardian must also read and agree to be bound by these T&amp;C\u2019s. You agree that You are responsible for paying the charges to use the Service, or if You are under 18, that You have permission to use the Service from the adult responsible for paying the charges.<\/p>\n<p>You acknowledge that Mozillion Ltd may immediately suspend certain services in order to comply with applicable laws. You are solely responsible for the content You transmit via the Service. We will not be responsible for any content sent or received by You.<\/p>\n<p>You are responsible for updating the Customer Service as soon as reasonably possible of any changes to your contact details.<\/p>\n<p><strong>8. Charges<\/strong><\/p>\n<p>In order to use the Service You must have a valid Data Plan. For a Data Plan to be valid, it needs to be neither exhausted nor expired and it needs to be valid in the country You are currently in. You can check whether You have a valid Data Plan via the Mozillion dashboard. When You are using the Service and your Data Plan runs out (i.e. exhausted or expired), the access to Internet will be automatically suspended.<\/p>\n<p>Your Data Plan will be debited per your usage of the Service (consuming your data allowance).<\/p>\n<p>Data Plan allowances may only be used for our Service on your Device, and You will not be entitled to receive any cash refund for any remaining credit or allowance unless expressly stated otherwise in this Agreement. Credits and allowances are not transferable, and no interest will be payable on credit balances or allowances.<\/p>\n<p><strong>9. Taxes and Other Charges<\/strong><\/p>\n<p>You must pay all taxes, fees, surcharges and other charges that we bill You for the Service. We will not provide advance notice of changes to taxes, fees, surcharges and other charges, except as required by applicable law.<\/p>\n<p><strong>10. When may we suspend or disconnect your Service<\/strong><\/p>\n<p>We may, without liability to You, suspend or disconnect the Service and\/or your (e)SIM card, without notice:<\/p>\n<p>a) If we are entitled to terminate this Agreement due to your failure to comply with this Agreement but elect to provide You with an opportunity to remedy such failure whenever reasonably practicable<\/p>\n<p>b) If we are required to do so by the Government and\/or emergency service organization or any other competent body or lawful authority<\/p>\n<p>c) For repairs or maintenance, or for operational or security reasons<\/p>\n<p>d) In circumstances where we observe fraudulent or unusual use of your (e)SIM card or one or more service (e.g. abnormally high usage patterns)<\/p>\n<p>e) If we have a good reason to suspect a breach by You of this Agreement<\/p>\n<p>f) If Mozillion Ltd or its partners become aware that your (e)SIM card has been stolen\/lost\/damaged or destroyed<\/p>\n<p>g) If your (e)SIM card or Device is interfering with the normal operation of the network or if your account is in arrears<\/p>\n<p>h) If You do not use the Services in compliance with applicable laws and regulations<\/p>\n<p>i) If You have continually not used the Service since You acquired the (e)SIM card and\/or if You have not refilled your account after your credit has expired for an extended period of time, in accordance with applicable laws<\/p>\n<p>j) If You use the (e)SIM card in a device other than the Device in which it was delivered<\/p>\n<p>k) If You did not use the (e)SIM card after eighteen (18) months<\/p>\n<p>If we suspend or disconnect your Service we will give You the opportunity to restart the Service during a period of 3 months after the Service has been suspended, provided You comply with the Mozillion requirements.<\/p>\n<p><strong>11. Internet access<\/strong><\/p>\n<p>We do not make any warranty as to the accuracy, completeness, reliability or continuous supply of the content or information contained on any third-party sites or resources accessed via the Service. We will not be responsible for any harm You suffer from any virus that gains access to your equipment, whether transmitted via the Service or otherwise. It is your responsibility to protect your equipment with suitable anti-virus software.<\/p>\n<p><strong>12. Devices<\/strong><\/p>\n<p>You must use the Service in accordance with this Agreement and any other reasonable instructions we or the Customer Service give You from time to time. In particular, You are not authorized to use the (e)SIM card in any other device than the Device it was delivered with.<\/p>\n<p>If you purchased specifically an eSIM Data Plan on the Mozillion website, or on other partners ecommerce platforms\/ marketplaces, It is your sole responsibility to ensure that your Device is eSIM compatible and not carrier-locked.<\/p>\n<p>You should always refer to the specifications of the manufacturer of your device to check compatibility.<\/p>\n<p><strong>13. Refund policy<\/strong><\/p>\n<p>For an eSIM profile with a preloaded plan purchased on our website: the refund of your preloaded eSIM profile is only possible if you have not scanned the QR code received by email after your purchase. If you have already scanned the received QR code, your refund request will be denied.<\/p>\n<p>For an eSIM profile with a preloaded plan purchased on our website because your phone is carrier-locked: refunds for \u201ccarrier-locked\u201d devices (or \u201c(e)SIM-locked\u201d) are not possible. It is mentioned within the cart that you need to confirm that your device is carrier-unlocked. In the case that your phone is carrier-locked, please note that you can contact the operator from whom you purchased your device and request it to be \u201cunlocked\u201d.<\/p>\n<p>Note: The preloaded eSIM data plans in the form of QR codes remain valid for 6 months from the date of purchase.<\/p>\n<p>For a top up purchased on your Mozillion account: If you have recharged your existing account, the purchased data plans cannot be refunded if you have started using the service.<\/p>\n<p>In case of proven technical issues to activate the Services due to Mozillion, a possible refund is available starting from the occurrence of the problem.<\/p>\n<p>The replacement of data plans or their transfer to other Mozillion accounts is not possible. To initiate a refund request, please reach out to the customer service team and attach the payment confirmation within 14 business days from the date of purchase (or the occurrence of the technical issue with the Services). Upon receipt, you will receive an acknowledgment of your request, and the refund will be processed within 10 business days through the original payment method used during the purchase.<\/p>\n<p><strong>14. Indemnity<\/strong><\/p>\n<p>In compliance with applicable laws, You agree, at your sole cost and expense, to fully defend, indemnify and hold harmless Mozillion Limited , its affiliates, subsidiaries, shareholders, directors, officers, employees, and agents from and against any and all claims, causes of action, actions, judgments, liabilities and\/or damages (including without limitation reasonable expenses and reasonable attorney\u2019s fees) arising out of or in connection with (i) your use of the Service, (ii) your Account (including the use of your Account by a third party) and (iii) this Agreement.<\/p>\n<p><strong>15. Limitation of Liability<\/strong><\/p>\n<p>EXCEPT FOR DAMAGES CAUSED BY OUR INTENTIONAL MISCONDUCT, WE WILL NOT BE LIABLE FOR DAMAGES THAT EXCEED THE AMOUNT OF OUR CHARGES TO YOU FOR YOUR ACTUAL USE OF THE SERVICE DURING THE PRIOR ONE-MONTH PERIOD. UNDER NO CIRCUMSTANCES WILL WE BE LIABLE FOR ANY DIRECT, SPECIAL, CONSEQUENTIAL, INCIDENTAL, INDIRECT, EXEMPLARY OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF PROFIT OR REVENUES, OR INCREASED COSTS OF OPERATION, EVEN IF SUCH DAMAGES WERE FORESEEABLE OR WE HAVE BEEN SPECIFICALLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND NO MATTER HOW THAT CLAIM IS STYLED OR ON WHAT LEGAL GROUNDS IT IS BASED (SUCH AS CONTRACT, TORT, STATUTE OR OTHERWISE).<\/p>\n<p><strong>16. WE ALSO MAKE NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR FREE. WE DO NOT AUTHORIZE ANYONE, INCLUDING OUR EMPLOYEES, AGENTS OR REPRESENTATIVES, TO MAKE A WARRANTY OF ANY KIND ON OUR BEHALF AND YOU SHOULD NOT RELY ON ANY SUCH WARRANTY. YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT BECAUSE THE SERVICE IS PROVIDED IN PART OVER NETWORKS OUTSIDE OF OUR CONTROL, THEY ARE SUBJECT TO OUTAGES, DISRUPTIONS AND INTERCEPTION, AND THAT WE HAVE NO LIABILITY FOR ANY SUCH OUTAGES, DISRUPTIONS OR INTERCEPTIONS. MOZILLION IS NOT RESPONSIBLE FOR THE CONTENT OF COMMUNICATIONS TRANSMITTED THROUGH THE SERVICE.<\/p>\n<p><strong>17. Assignment<\/strong><\/p>\n<p>We may assign all or part of our rights and duties under this Agreement to any party at any time without notice to You. If we do that, we will have no further obligation to You in connection with such assigned duty. You may not assign your rights and duties under this Agreement without our prior written permission.<\/p>\n<p><strong>20. Severability<\/strong><\/p>\n<p>If any provision of this Agreement is held to be invalid, illegal or unenforceable, the remaining provisions of this Agreement will continue in full force and effect.<\/p>\n<p><strong>21. Integration \u2013 Entire Agreement<\/strong><\/p>\n<p>This Agreement, together with any written amendments or written modifications, will constitute the entire Agreement between You and Mozillion Ltd with respect to the Service and will supersede and replace all prior or contemporaneous understandings or agreements, written, electronic or oral, between You and Mozillion Ltd. No written or oral statement, advertisement or service description not expressly contained in the Agreement will be allowed to contradict, explain, modify or supplement it. You acknowledge and agree that You are not relying on any representation or statement by Mozillion Ltd that is not included in this Agreement.<\/p>\n<p><strong>22. Force Majeure<\/strong><\/p>\n<p>Mozillion Ltd shall not be held responsible for any delay or failure in performance of any part of this Agreement to the extent that such delay or failure is caused by fire, flood, explosion, war, embargo, government requirement, civil or military authority, act of God or other similar causes beyond Mozillion\u2019s control.<\/p>\n<p><strong>23. No Waivers<\/strong><\/p>\n<p>Mozillion\u2019s failure to exercise any of its rights hereunder upon breach by Customer or pursuant to any condition, covenant or provision contained in this Agreement shall not be construed as a waiver thereof, nor as a waiver of the same or any other default subsequently occurring.<\/p>\n<p><strong>24.
